    Appeal Court sitting in Calabar has dismissed Senator John Owan Enoh’s case, declaring Sen. Bassey Otu the authentic C’River APC governroship candidate.

     

    This somewhat brings to an end  the legal tussle between Sen. John Owan Eno and Sen. Bassey Otu over who is the candidate of APC. Otu polled 887 votes to defeat Sen Owan Enoh who scored  84 votes.

     

    In Suit No:CA/C/337/2022 between Senator John Owan Enoh appalant vs Senator Bassey Edet Otu  third respondent Vs All Progressives Congress APC and two others, the chairman of the Appeal Court  panel in company of two others judge, Hon. Justice J. O. Bada, dismissed the case in  favour of senator Edet Bassey Otu for lack of merit saying Otu is  authentic  Cross River State APC Gov’ship candidate.

    The Federal High Court in Suit No.FHC/CA/061/2022 and presided over by Justice Ijeoma Ojukwu had declared that Sen. Otu was validly elected as APC candidate.

    Not satisfied with the High Court Judgement, Senator John Owan Enoh headed for the Appeal court to get a fair judgement.

    And in Suit No:CA/C/337/2022 between Senator John Owan Enoh appalant and Senator Bassey Edet Otu,  All Progressives Congress APC and two others the court demised the case for lack of merit.

    Chairman of the Appeal Court  panel in company of two others judge, Hon. Justice J. O. Bada, dismissed the case in  favour of senator Edet Bassey Otu for lack of merit, saying Otu is  authentic  Cross River State APC Governorship candidate.

    The panel stated that the third respondent, Sen.  Bassey Edet Otu, was fully cleared stressing that the mandate given to him by the APC National working Committee and the the lower court was genuine.

    Reacting to the Judgement, lead counsel for the appalant, J. A. Dakim, Esq, and William Agbor, who refused to explain the next action to be taken, told   journalists in an interview, stated that he is not satisfied with the judgement and would consult with his client.

    In his remarks, Head of legal team of Sen. Bassey Edet Otu  campaign Organisation, Utum Eteng,  in company of Otu’s lead counsel, Pius Away, Etim Inyang and Leonard Anyugo, who stood in for third respondent, lauded the court for deliverying the judgement in favour of Otu whom the party has given the Gov’ship Candidate for APC.
